Great damage has already been done. Whether you want to blame the Democrats for pushing for the release of the Trump-Zelensky transcript, the White House for catering to their demands, or the intelligence community (and thereby the Deep State) for creating their whistleblower, that’s your prerogative. But what must not happen going forward is the release of any conversations this or any future President has with a a foreign leader.
The President has the power to keep them classified and must do so from now on. He must ignore any future pressure to release them, pressure that appears to be ramping up right now.
Democrats are now eying Trump’s phone calls with Putin
Rep. Adam Schiff said the House Intelligence Committee wants to know more about about Trump’s calls with Putin.
House Intelligence Committee Chairman Rep. Adam Schiff (D-CA) would like to obtain more of President Donald Trump’s phone calls with world leaders — especially those with Russian President Vladimir Putin, although that’s the last thing the Kremlin wants.
The White House has released a record of a phone call Trump held with Ukrainian President Volodymyr Zelensky to rebut a whistleblower’s allegations Trump asked a foreign leader to investigate a political opponent. The White House’s record of that call did contain Trump asking Zelensky to investigate former Vice President Joe Biden, and the whistleblower claims the administration placed its notes from the call in a system meant only for highly classified material in order to keep the request secret.
There is an expectation of confidentiality when world leaders get on the phone or meet in person. Sure, there are leaks that can happen on both sides, but it’s dangerous to release entire transcripts that include a foreign leader speaking ill of other foreign leaders, as President Zelensky did of Angela Merkel, Emmanuel Macron, and other European leaders. It’s understandable that the President wanted to stave off impeachment calls and embarrass the Democrats by showing nothing bad was said in the call, but it should have been at least redacted. Transparency harmed the country in this case.
Now, it’s time for damage control. The President must shut down any potential of releasing transcripts going forward. An executive order would do the trick temporarily, followed by a law against it. These would include language that requires permission from both sides for any transcripts to be released, and for the redacted version to be approved. This was the case with Zelensky, who gave permission to Secretary of State Mike Pompeo.
This isn’t necessary from a legal perspective; the President has the power to keep it all classified regardless of what Congress or the courts do. But in an effort to repair the damage done to foreign relations going forward, the President must make a statement in the form of an executive order now and a law when the GOP has control of both chambers again.
Some will note the optics on such a move will harm reelection chances. But this is a Pandora’s Box that will stifle negotiations with foreign nations going forward. The box needs to be closed and the only way to do that effectively is by decree and codification. We need world leaders to trust that their private conversations are, indeed, private.
To repair damage, the President must issue an executive order declaring no transcripts with foreign leaders may be released without permission from both parties. Then, the 2021 GOP majority must codify it. We lose all credibility otherwise.
