White House to change Flores Agreement allowing longer detention of asylum seekers Report

The Flores Agreement has been arguably the biggest draw for asylum-seeking migrants who have created the border crisis in recent months. In the agreement, children may not be held in migrant facilities for longer than 20 days, which gives families a quick release into the United States interior as well as, in most cases, work permits.

According to a report by One America News correspondent Ryan James Girdusky, the White House will be unveiling changes Wednesday or Thursday this week. These changes will allow for longer detention of family units. This is important because asylum hearings never happen within the 20-day Flores period, forcing asylum seekers to be released before their claims are adjudicated. With 90% of asylum seekers not showing up for their hearings after they’re released, according to acting Homeland Security Secretary Kevin McAleenan, children have become essentially a free ticket to the United States interior.

Enacted in 1997 as an agreement to deal with the repercussions of a 1987 case, Flores v. Reno, it has been used as the standard by which illegal immigrants family units and unaccompanied minors are to be treated while in border patrol custody. It was intended as a humanitarian control to ensure children crossing the border illegally had proper facilities and care. Moreover, it established the protocols required to seek out the nearest relatives with which to place unaccompanied children.

In theory, the agreement was properly conceived and administered. But with the influx of migrants since last year who are conspicuously armed with knowledge of loopholes to help them circumvent our laws, calls have been made by conservative groups to reexamine the Flores Agreement. It was never meant to be the release loophole it has been turned into today. It was intended to protect children, but today it is putting them in more jeopardy as they’re being used as “tickets” for entry and release. Many are being “rented” or even sold to people in a “marketplace of children” at the border.

MS-13, the notorious transnational gang spreading extreme heinous violence across North and South America, is conspicuous in their use of children because of the current state of the Flores agreement.

Now that word is being spread for MS-13 gang members to grab kids and use them to cross the border, the left’s policies are being used to harm innocent children in Central America. The “compassion” of the left is doing so much harm to everyone involved… everyone other than the gang members they are graciously supporting with their policies.

Changing the Flores Agreement will have an immediate and substantial impact on the border crisis. Illegal immigrants will no longer be able to use children as “tickets” to get released into the interior. This is a spectacular move by the White House.

Asylum agreement with El Salvador is silly

The Trump administration has come to an “asylum cooperative agreement” with El Salvador that means anyone who passes through the nation must have been rejected asylum there in order to apply for asylum in the United States. Acting Homeland Security Director Kevin McAleenan signed the agreement Friday.

Unlike similar agreements in the works with Mexico and Guatemala, this one makes no sense. To understand why, look at a map.

El Salvador

Keep in mind, migrants FROM El Salvador would not be affected by this agreement since it would be El Salvador from which they’re seeking asylum. This means the agreement will only apply to those who go out of their way to cut through El Salvador from Honduras, which will be effectively zero. Even those who do will claim they went through Honduras to Guatemala, so the agreement is meaningless.

But it’s actually worse than meaningless. Every move the administration makes to secure the border will be viewed through a critical judicial lens. By signing an agreement with El Salvador, a nation rife with violence, it makes other agreements vulnerable as well. We do not need to be wasting time in court battles over an agreement that will have no practical effects because doing so allows th activist judiciary another opportunity to strike at effective agreements such as the one in place with Mexico and the one in the works with Guatemala.

This was a symbolic effort, one that is not only unnecessary but also puts real efforts at risk. I back the President’s plays on the border the vast majority of the time, but this one makes absolutely no sense.

Illegal immigrant convicted of killing NFL player has additional years added to sentence

A Guatemalan national who has reentered the country illegally at least twice was convicted of killing an NFL player and his Uber driver. Now, a federal judge has added 42 months to his prison sentence for illegally reentering the country.

Manuel Orrego-Zavala, 38, swerved and struck Jeffrey Monroe’s vehicle after he had pulled over because Indianapolis Colt’s linebacker Edwin Jackson was feeling sick. Both men were killed instantly. He was sentenced to 16 years in prison. When that sentence is complete, he will be transferred to a federal penitentiary where he will serve the additional 3.5 years.

U.S. District Chief Judge Jane E. Magnus-Stinson handed down the sentence this week.

Fox News host Shannon Shannon Bream discussed the sentence with U.S. Attorney Josh Minkler as well as ways illegal immigration laws must be enforced to prevent further crimes committed against American citizens.

Migrant surge lessens allowing criminal apprehensions at border to rise

The number of migrants and asylum seekers crossing the border to be willfully apprehended by border patrol agents has been on a sharp decline since May. Conversely, the number of smugglers, formerly deported criminals, and potential terrorists being apprehended by border patrol has gone up in the same time period.

Resources have been strained for months as border patrol contends with the masses of humanity flooding the border seeking asylum. But efforts by Mexican law enforcement, hot weather, and changes in asylum policies have reduced the number of people making it across the border.

With the reduced need to do paperwork and cater to the migrants, border patrol agents have been allowed to do their pressing work of securing the border and locating illegal immigrants who do not want to be found.

On September 12, during routine activities, Border Patrol Agents assigned to the Alamogordo Station Highway 54 Checkpoint discovered three bundles of heroin with an approximate weight of 9 lbs. Both driver and passenger were taken into custody and turned over to the Drug Enforcement Administration along with the heroin.

During a separate incident near Ft. Hancock Station, Border Patrols Agents received a citizen report of possible illegal alien activity. Responding Agents encountered a U.S. Citizen who was wanted for Failure to Register as a Sex Offender in Austin. Further records checks revealed an extensive criminal history, including a conviction for Sexual Assault. The subject was turned over to Hudspeth County Sheriff’s Office for extradition.

Opinion

File this under “duh.” Of course border patrol is able to apprehend more criminal illegal immigrants when they’re not spending so much time passing out diapers and filling out paperwork for migrants. We’ve long said the biggest threat from the migrant surge isn’t the migrants themselves but the criminals they aid and abed by drawing attention away from border patrol’s mission to keep the borders secure.

This also means Mexico deserves huge kudos from patriots who may have been skeptical about their desire to stop the flow of migrants crossing our borders. They’ve kept their promise and slowed the flow dramatically before migrants are able to step foot on U.S. soil.

The fight is far from over. As weather cools and migrants attempt another surge, it will be imperative for Mexico to keep up the pressure and for the administration to do everything in its power to dissuade attempts to cross the border. Congress isn’t going to help until Republicans can take back control of the House. Until then, it’s up to the White House to keep us safe.

Final Thoughts

This news runs contrary to the Democrats’ narrative that border patrol’s job is not being hampered by Congressional policies or their push for open borders. Now that they’re processing fewer migrants, they’re actually catching many more bad guys.
