Senator Ted Cruz is among many Republicans on Capitol Hill who have been in lockstep with the President, especially when it comes to nominations to the judiciary. But one judge the President nominated made comments that set off Senator Josh Hawley. Now Cruz is backing Hawley’s play.
In a story published by National Review, Hawley continued recent attacks against Michael Bogren, a nominee for the bench in Michigan.
Mr. Bogren responded with a scorched-earth strategy in his litigation against the Tennes family. He wrote, “Plaintiffs attempt to dress their arguments up in a shimmering gown of First Amendment and religious righteousness and parade it down the runway of moral superiority. When stripped of its costume, however, what lurks beneath is simply this: discriminatory conduct.”
He compared their Christian beliefs about marriage to the racism of the Ku Klux Klan, arguing that following the teachings of their faith by not celebrating same-sex weddings on their farm was “no different than the ‘White Applicants Only’ sign.” He also attacked the sincerity and the consistency of their beliefs, arguing that they only “selectively” apply their faith to their lives.
Following the article, Cruz spoke up and asked the President to withdraw the nomination.

If all Democrats vote against, Cruz and Hawley would need two more Republicans to join them. But it’s not guaranteed the Democrats will vote against him. According to The Right Scoop, this nomination may be a play for the Democrats.
As I’ve been looking into this more, I now suspect that this nominee from Trump may just be something to appease Democrats so that he can continue to push his agenda through. This isn’t anything new, either. For decades Republicans have been making concessions to Democrats on district court judges in order to push through stronger constitutional judges to the appellate courts and the Supreme Court. If Bogren is in fact a token liberal judge, we should see Democrats vote en masse for him when his name comes up in the Senate.
At the rate Mitch McConnell is pushing through judicial nominees, we should see Michael Bogren’s name come up soon. When it does, it’ll be an interesting vote to watch. Will a progressive hit the Trump bench?
