A judge in Watertown, NY, sentenced a bus driver who admitted to raping a 14-year-old girl to ten years probation. He was ordered to register as a level 1 sex offender, meaning he will not be on any online databases of sex offenders.
Judge James P. McClusky from the 5th Judicial District in Jefferson County, New York, cited no previous arrests and the singularity of the victim as reasons for the light sentence. Shane M. Piche, 26, a bus driver, admitted to raping the girl in his residence after giving her alcohol. He met her on his bus.
Opinion
There are certain circumstances that must be taken into account in some rape cases. This isn’t one of them. Even in New York, 3rd degree rape doesn’t seem to fit this crime. Any adult who has sex with someone under 15-years-old is 2nd degree rape with up to seven years in prison, but somehow the math was fuzzy for this judge.
It’s just a good thing Piche didn’t steal a television or sell a bag of marijuana. He’d be in jail for sure.

If a 26-year-old man rapes a 14-year-old girl, I don’t care what his past was. He should get jail time. This is ridiculous.

Just a few years ago, big media would follow Judge James P. McClusky with camera and probing questions. Then we’d see him shamed from office. That’s what the 1st Amendment is supposed to do. Most don’t care if many 14-year-old girls “look like” they’re 25. Courts have repeatedly ruled that minors cannot consent to sexual acts.
