In what law enforcement officials are categorizing as a clear example of how our immigration laws are broken, a Cuban national and convicted violent felon was released to the streets of Miami despite deportation orders. Cuba refused to take him, and current immigration laws prompted law enforcement to let him go.
Last month, David Paneque, 29, shot his “friend” Leandro Lopez several times at point blank range. The entire incident was captured on video. While being questioned by police, Paneque admitted to known Lopez and dropping him off at the scene of the crime. Once police showed him the video, he invoked his right to remain silent.
Paneque has a history of violence, including an attempted murder conviction following a stabbing during a robbery in 2007 that landed him in jail. Once there, he extended his sentence by attacking a prison guard. He is a known member of the Sur-13 where he is known by the nickname, “Psycho.”
Cuban relations with America have improved in recent years, but they only take a tiny fraction of their nationals assigned for deportation. Around 500 of the 37,000 Cuban nationals who are facing orders of removal have been accepted by Cuba, putting law enforcement in an awkward situation. They cannot detain illegal immigrants, even violent ones, beyond a certain point. If their home country won’t take them back, current law demands they are released back to the streets.
The immigration laws in our country were not designed for the level of illegal immigration we’re seeing today. Not only are we incapable of securing our borders and keeping illegal immigrants from entering. The problem is compounded when people like David Paneque are released to the streets even after a history of extreme violence and gang activity because our laws force it to happen.
The illegal immigration problem has many fronts. It isn’t just about a wall. It’s about giving border patrol the manpower, equipment, and facilities they need to do their job. But it’s also about fixing the laws that protect criminal illegal immigrants and force them back on the streets where they can do harm to American citizens.
What ideology promotes this? What sort of nation allows this? The left has been pushing these sort of perversions into the law of the land for too long. It’s time to reverse the trend and prevent illegal immigrants from continuing to commit crimes against us.
“This illustrates a major flaw in our immigration laws. Even though this individual is an undocumented immigrant with a history of violent crime, by law, he had to be released.” – Former Miami U.S. Rep. Carlos Curbelo
No matter which way you slice it, this represents a HUGE problem for Americans. It’s bad enough illegal immigrants can come and go from the country as they please. It’s worse knowing our laws require them to be released to commit more crimes.
